Complete Rules of the Contest
"Sena 60S Contest - Europe 2024"
From November 5th to November 10th, 2024

BY PARTICIPATING IN THE CONTEST, YOU EXPRESSLY AND UNCONDITIONALLY ACCEPT THESE RULES.

IF YOU DO NOT WISH TO ACCEPT THESE RULES, PLEASE REFRAIN FROM PARTICIPATING IN THE CONTEST.

ARTICLE 1: ORGANIZER
The company SENA SAS, with a capital of €200,000, registered with the RCS of Meaux under the Siret number 848 098 810 00015, and located at 17, Boulevard Robert Thiboust, 77700 Serris (hereinafter referred to as the "Organizer"), is organizing a contest from November 5th, 8:00 a.m. to November 10th, 2024, 11:00 p.m., requiring a purchase, called the "Sena 60S Contest - Europe 2024" (hereinafter referred to as the "Contest").

ARTICLE 2: ACCESS AND CONTEST PERIOD
The rules of the Contest are accessible from November 5th, 2024, at 8:00 a.m. until November 10th, 2024, at 11:00 p.m., on the Organizer’s website, accessible online.

It is expressly stated that participation requires Purchase.

ARTICLE 3: PURPOSE AND COMMUNICATION OF THE CONTEST
To participate in the Contest and have a chance to win the prize, in addition to the conditions defined in these rules, each participant must meet the following participation conditions:

  • Read and accept these rules unconditionally;
  • Make the order of a 60S Intercom (Single Pack or Duo Pack), priced at €399 including tax for the single pack and €799 including tax for the dual pack, excluding shipping fees, with full payment, all before November 10th, 2024, at 11:00 p.m. (hereinafter referred to as the "Purchase"); and
  • Do not cancel, withdraw, invalidate, or terminate the Purchase.

The purpose of the Contest is as follows: to allow individuals who have made the Purchase through Sena’s website (https://store-eu.sena.com) under the conditions set forth in these rules to win the prize.

The communication of this Contest is done through the following media:

ARTICLE 4: REGISTRATION AND PARTICIPATION

4.1 Participation in the Contest implies the express and unconditional acceptance of these rules and all its provisions, as well as the laws and regulations applicable to contests in force in France.

4.2 This Contest is only open to any individual over the age of majority residing in the European Union. The participant must be available from November 16th to November 17th, 2024, to travel to Barcelona, Spain, to benefit from their prize.

Employees of the Organizer and the Agency, as well as their family members (spouse, direct ascendants and descendants, siblings) regardless of where they live, and anyone who contributed to the creation of the Contest, are not allowed to participate.

To participate, it is mandatory to have made the Purchase on Sena’s website.

4.3 To participate, each participant must:

  • Visit Sena’s website from November 5th, 2024, at 8:00 a.m. until November 10th, 2024, at 11:00 p.m.;
  • Read and accept these rules without reservation;
  • Make the Purchase;
  • Not cancel, withdraw, invalidate, or terminate the Purchase.

No other means of participation will be considered.

4.4 The participant is informed that the personal information they provide during the Purchase  serves as proof of their identity, which they accept. These details must remain valid for the entire duration of the Contest and for the month following the Contest's closure date.

4.5 The Organizer reserves the right to verify the accuracy of the data provided by the participant by requesting a copy of an identity document.

ARTICLE 5: RESPECT FOR THE INTEGRITY OF THE CONTEST
Participants are prohibited from implementing or attempting to implement any participation process that does not strictly comply with the principles of the Contest and these rules. The Organizer reserves the right to disqualify any participant who alters the proper functioning of the Contest or violates the provisions of these rules. The Organizer also reserves the right to take legal action against anyone attempting to cheat or disrupt the Contest.

The Organizer reserves the right to extend, shorten, modify, or cancel the Contest due to events beyond its control. If, for any reason, the Contest does not proceed as planned, for example, due to intervention, fraud, failure of any kind, or any other reason beyond the Organizer’s control that corrupts or affects the management, security, fairness, or proper conduct of the Contest, the Organizer reserves the discretionary right to cancel, modify, or suspend the Contest or end it without delay, without the participants being able to hold the Organizer responsible.

The Organizer may decide to cancel the Contest if clear instances of fraud have occurred in any form, whether during participation in the Contest or the determination of winners or prizes.

If the winner cancels, withdraws, invalidates, or terminates the Purchase, the winner shall compensate for all direct and indirect expenses and costs incurred by the Organizer for the prize.

ARTICLE 6: EVIDENCE AGREEMENT
It is agreed that the data contained in the Organizer’s information systems serve as proof regarding the connection elements and the information resulting from a computer process related to the Contest organized by the Organizer.

ARTICLE 7: SELECTION OF WINNERS
Winners will be informed by email or phone on November 6th, 2024.

If a winner has not complied with the rules, they will lose their entitlement to the prize, which will be awarded to a substitute winner.

ARTICLE 8: PRIZE
The prize concerns the MotoGP race in Barcelona, taking place from November 15th to November 17th, 2024, at the Montmelò Circuit (Carretera de Granollers a Parets, Carrer Mas Moreneta, s/n, PKM 2.5, 08160, Barcelona, Spain) (hereinafter referred to as the "Event"). On this occasion, the three winners will each receive the following prize:

  • Two VIP tickets valid from November 16th to November 17th, 2024 (one for the winner and one for a guest of their choice) for the Grand Prix motorcycle race taking place in Montmelò, Spain, with access to Team Honda LCR’s hospitality
  • Travel expenses for the winner and their guest, up to a total of €600, upon submission of receipts
  • Accommodation near the circuit.

The prize only includes the elements listed above and does not cover other expenses, including:
o Meals on-site;
o Personal expenses; and
o All expenses related to the event and/or not specified above.

ARTICLE 9: DELIVERY OF PRIZES
Winners will be informed of their win, and tickets for the Event will be sent to them by email starting from November 11th, 2024, to the address they provided when making the Purchase. If the contact information is incomplete, illegible, or unusable, and as a result, the winner cannot be reached, or if it turns out that their participation did not comply with these rules, they will lose their entitlement to the prize, which will be awarded to a substitute winner.

If the substitute winner cannot be reached or has not participated in accordance with these rules, their participation will be canceled, and they will lose their entitlement to the prize, which will not be reassigned.

Each prize awarded is non-transferable unless the participant has expressed, at the time of Purchase, their intention to allow one (or two) third parties to benefit from their potential prize. In this case, they must provide Sena with the contact details of these persons at the time of Purchase. Each prize cannot be exchanged for cash or any other equivalent, nor replaced by a prize of equivalent nature. The Organizer may replace any prize, in case of force majeure, with a prize of equivalent nature and value.

ARTICLE 10: DISPUTES
Participation in the Contest implies full and unconditional acceptance of these rules.

These rules are governed by French law. For any dispute not resolved amicably, and unless otherwise provided by law, the judicial court of Paris will have sole jurisdiction.

ARTICLE 11: COMMUNICATION OF WINNER'S IDENTITY
The winner authorizes, unless otherwise notified, the Organizer to use the information regarding his identity and residence in its communications related to the Contest, regardless of the Organizer’s media (printed documents, press, posters, TV, radio, Internet, including social networking sites such as Facebook, etc.), in Europe, for a period of three (3) months, without this use entitling them to any other rights beyond the Contest. For Internet media, the territory is worldwide.

ARTICLE 12: PERSONAL DATA PROCESSING
During their participation in the Contest, the participant must provide the Organizer, who is responsible for processing, with personal data concerning them.

The Organizer is the data controller and processes personal data concerning the participant, in compliance with Regulation 2016/679 of April 27th, 2016
